The film is based on Lipstadt's book History on Trial: My Day in Court with a Holocaust Denier , which recounts the 1996 libel lawsuit Irving filed against her and her publisher, Penguin Books.

Under British libel law at the time, the burden of proof lay with the defendant. To win, Lipstadt and her legal team had to prove that the Holocaust occurred and that Irving had intentionally manipulated historical evidence.

The script, written by David Hare, famously utilized actual court transcripts for the courtroom scenes to ensure historical accuracy.
